Membership Purchase Terms and Conditions

All Memberships exclude activities/events separately priced. Membership types, entitlements and prices subject to change without notice. Memberships are non transferable and non refundable. Sweet Eats reserves the right to reschedule or cancel Farm reservations, admission media or purchases at any time and for any reason without liability, and to provide applicable refunds. Farm reservations are subject to availability and are not guaranteed for any specific dates or farm.Sweet Eats Fruit Farm These terms and conditions apply to the purchase and use of a (“Membership”). By purchasing a Membership, you agree to become a Sweet Eats Fruit Farm  Membership holder (“Membershipholder”) and must comply with these terms and conditions, as well as any other applicable terms, conditions or agreements, including but not limited to, The Sweet Eats Fruit Farm Admissions Product Terms & Conditions.

MEMBERSHIP PURCHASE: You agree that all annual memberships are a 12-month contractual agreement that will be charged monthly. If this contract is broken before the end of the 12-months there will be an early termination fee of the total amount due immediately. 

You must contact us directly in order for the monthly memberships to end. Until that time the membership will continue to bill on a monthly basis.

ONE-TIME MEMBERSHIP PURCHASE: You agree that all ONE-TIME annual memberships are a 12-month contractual agreement that will be charged once with a fee of the total amount due immediately.

MEMBERSHIP EXPIRATION: For a new Membership purchase (not a renewal), a Membership is valid for applicable privileges for one (1) year  or Twelve (12) months from the date of Purchase of the Membership. No refunds will be given. The Membership may not be transferred, and the amount paid for the original Membership may not be redeemed for cash or be used for any other purpose other than the purchase of another Membership or ticket. 

GENERAL:

1. A Membership must be used by the same person on any and all farm visits and benefit redemptions with the Membership. Further identification may be required.
2. Memberships are not valid for separately priced events that require separate admission or are not open to the general public.
3. Memberships are non refundable and are nontransferable. Memberships remain the property of Sweet Eats and may be revoked at Sweet Eats’s discretion. Restrictions apply as described in these terms and conditions, including, but not limited to, capacity constraints, availability of farm reservations allocated to Memberships as determined by Sweet Eats and closures. Memberships may not be redeemed for cash or used for commercial purposes and are void if altered or misused.
4. A Membershipholder assumes all inherent risks associated with all rides and attractions and must obey all safety signage, instructions and rules. Sweet Eats is not responsible for lost or stolen Memberships or property.
5. Entry into the Sweet Eats Fruit Farm constitutes consent for Sweet Eats or its affiliates to use any film, video or reproduction of the image and/or voice of a Membershipholder for any purpose whatsoever without any payment to the Membershipholder. A Membershipholder must abide by any rules and regulations applicable to the Sweet Eats Fruit Farm  or to the use of the Memberships as promulgated by Sweet Eats from time to time.
6. Sweet Eats reserves the right to cancel, suspend or revoke any Membership or deny farm admission, prevent entry or require a Membershipholder already admitted to leave the Sweet Eats Fruit Farm  at any time for any reason, including, without limitation, if they are violating any farm rules or policies.

Membership TYPE AVAILABILITY: Sweet Eats may limit the quantity or terminate the sale of Memberships and Membership types, and Memberships or a Membership type may not be available for purchase or renewal from time to time or at any given time. Please check for Membership and Membership type availability before attempting to purchase or renew.

UPGRADES: Upgrades may be available from time to time or at no time, as determined in Sweet Eats’s discretion. The difference in prices must be paid in full at the time of the upgrade. If Sweet Eats makes available an upgrade to a Membership from a lower level Membership at any time, the new Membership will NOT have the same expiration date as the original Membership. Upgrades are subject to Membership availability as determined by Sweet Eats.

DOWNGRADES: are not allowed.

RENEWALS: The value of any separate ticket media may not be used toward the renewal of an existing Membership. A “renewal” is the purchase of another year (or specified period of the Membership if different than a year) of Membership benefits during the “renewal window” specified by Sweet Eats. Membership types may be made available for renewal at Sweet Eats’s discretion. If Sweet Eats makes renewals available, Membership holders may be limited in the Membership types they can renew into and the Membership types available for renewals may be different for different types of Membership holders. Any renewal discounts are valid during the dates specified for such discounts, may vary depending on the Membership type and are subject to change without notice or liability. If a renewal to a Membership is made during the renewal window, but after the original Membership expired, the renewed Membership will be backdated to begin on the day after the expiration date of the original Membership.

BENEFITS/DISCOUNTS: A Membershipholder must present their valid Membership and valid photo identification prior to purchases or offer redemption to receive any applicable benefits, discounts or other offers. Further identification may be required. Discount amounts and benefits may be dependent on Membership type. Benefits and discounts are valid in person only at Sweet Eats Fruit Farm. Subject to exclusions, restrictions, and change or cancellation without notice or liability, and may not be combined with any other offer or promotion. Such benefits and discounts are for personal use only and may not be used for any commercial purpose or for the benefit of others, including, without limitation, to obtain or purchase items or services with the intent to resell such items or services, or to share benefits with persons who are not the sole Membershipholder.

COMMUNICATIONS: As a member of the Sweet Eats Fruit Farm  Membership program, a Membershipholder will be eligible to receive periodic mailers and newsletters and other communications about the Sweet Eats Fruit Farm , other Sweet Eats affiliated products and services and select unaffiliated, third party Membershipholder offers, including, without limitation, information about events, products, opportunities, services and special offers and discounts available to Membership holders. Membership holders may also be sent information about special events, products, services and offers based on their activities at the Sweet Eats Fruit Farm  (e.g., purchase transactions, etc.). These communications may be sent by various channels, including by postal mail (one mailing per Membershipholder household/address) or by email, based on the permissions and contact information provided by you. Membership holders may receive these communications from any of the subsidiary and affiliated entities of The Sweet Eats Fruit Farm. Please be aware that if you do not allow us to send you certain communications, we may not be able to deliver information to you about special Membershipholder events and opportunities, or about products and services that may be available to Membership holders or that may take into account your interests and preferences.

ADDRESS CHANGE: Please report a change in your address immediately to the Sweet Eats Fruit Farm Membership Program. Changes can be made by signing into your My Sweet Eats Experience account and clicking on Account Settings.

ADDITIONAL TERMS AND CONDITIONS FOR APPLICABLE OPTIONS
All options are nontransferable and nonrefundable and exclude activities/events separately priced. Farms, attractions and other offerings are subject to availability, closures and change or cancellation, as determined by Sweet Eats and without notice or liability.

We reserve the right to remove or refuse to post photos or other digital content of poor quality or photos or other digital content with inappropriate or offensive subject matter in our discretion.

We are not responsible for missing, lost or damaged photos or other digital content. Online registration is required.

All terms, conditions and benefits of Memberships and options, including, but not limited to, Farm capacity, admission privileges, blockout dates, Farm reservation requirements, availability of Farm reservations allocated to Memberships, Membership type availability, prices, Farming, discounts and all other Membership benefits are subject to restrictions, availability, and change or cancellation without notice at any time as determined in Sweet Eats’s discretion and without liability.

AGREEMENT AND WARNING: I UNDERSTAND AND ACKNOWLEDGE THAT AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AGRITOURISM ACTIVITIES. I UNDERSTAND THAT I HAVE ACCEPTED ALL RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS THAT MAY RESULT FROM AGRITOURISM ACTIVITIES.

WARNING: UNDER TEXAS LAW (CHAPTER 75A, CIVIL PRACTICE AND REMEDIES CODE), AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AN AGRITOURISM ACTIVITY.
